Last updated: March 2026
§1 Scope
These General Terms and Conditions apply to all rental agreements for film and video equipment between:
Nick HeymannVideography & Marketing
Meuronstieg 1B
22303 Hamburg, Germany
VAT ID: DE342452105
– hereinafter referred to as "Lessor" – and the respective Lessee. Deviating terms of the Lessee shall only be recognized if the Lessor has expressly agreed to them in writing.
§2 Rental Items
- The rental items are specified in the respective booking confirmation.
- The condition of the equipment is jointly documented at handover (photo/video record).
- Serial numbers are recorded at handover and noted in the booking confirmation.
- By accepting the equipment, the Lessee confirms its proper condition, unless defects are noted in the handover protocol.
§3 Rental Period & Return
- The rental period is as agreed in the booking confirmation.
- Pickup and return times are arranged individually.
- Late returns are charged at the full daily rate for each additional day (or part thereof).
- Extensions must be requested in writing (email is sufficient) at least 24 hours before the end of the original rental period. There is no entitlement to an extension.
§4 Pricing & Payment
- All listed prices are net prices plus the applicable VAT of currently 19%.
- Payment is processed via Stripe at the time of booking.
- A mandatory insurance surcharge of 5% is applied to the net rental price (see §6).
§5 Security Deposit
- The deposit amount depends on the respective rental item or bundle and is displayed in the booking overview.
- The deposit is held as a credit card authorization (no charge).
- The deposit is released within 5 business days after the equipment is returned in proper condition.
- The deposit covers: outstanding rental fees, damage to rental items, and costs from late returns.
§6 Insurance & Liability
- All rentals include a mandatory insurance surcharge of 5% on the net rental price.
- With this insurance, the Lessee's deductible (Selbstbeteiligung) is EUR 250.00 per damage incident.
- Without insurance, the Lessee would be liable for the full replacement value – since insurance is mandatory, this option does not apply.
- The Lessee must report any damage to the Lessor immediately (within 24 hours at the latest) in writing.
- Normal wear and tear (e.g., minor signs of use) is excluded from liability.
- Intentional damage and gross negligence are excluded from insurance coverage. In such cases, the Lessee is liable for the full replacement value.
§7 Renter Obligations
- The Lessee is obligated to handle the equipment with care and in accordance with its intended use.
- Subletting to third parties is prohibited without the express written consent of the Lessor.
- Use under extreme conditions (underwater, extreme cold/heat, sandstorms) requires prior written consent from the Lessor.
- A valid government-issued photo ID (passport or national ID card) must be presented at pickup.
- For drone rentals, a valid EU drone pilot license (A1/A3 competence certificate or A2 remote pilot certificate) must be presented.
§8 Cancellation
- Free cancellation up to 48 hours before the rental start.
- Cancellation 24–48 hours before rental start: 50% of the rental price.
- Cancellation less than 24 hours before rental start: 100% of the rental price.
- Cancellations must be submitted in writing (email to [email protected]).
§9 Limitation of Liability
- The Lessor is not liable for production delays or cancellations caused by equipment malfunction.
- The Lessor's liability is limited to providing replacement equipment or refunding the rental price.
- The Lessor is not liable for indirect damages, lost profits, or consequential damages.
§10 Data Protection
The Privacy Policy applies. ID data collected for the purpose of the rental agreement is stored for the duration of the rental and the statutory retention period (generally 10 years pursuant to §§ 147 AO, 257 HGB under German tax law) and deleted thereafter.
§11 Final Provisions
- The laws of the Federal Republic of Germany shall apply.
- The exclusive place of jurisdiction for all disputes arising from the rental relationship is Hamburg, insofar as the Lessee is a merchant, a legal entity under public law, or a special fund under public law.
- Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid provision shall apply that most closely reflects the economic purpose of the invalid provision.
- Amendments and additions to these Terms must be made in writing.
